I-9 Compliance Procedures and Best Practices

Course Description:

The Obama administration has replaced immigration raids with a quieter enforcement strategy: sending federal agents to scour companies’ records for illegal immigrant workers.

In fact, as of August 6th, ICE said 2,393 companies were being audited. That's the largest number in a single fiscal year.

This type of “forensic” audit requires a comprehensive review of the employer’s business records, including:

  • Forms I-9 (Employment Eligibility Verifications),
  • Payroll reports, unemployment insurance tax reports, and quarterly tax statements,
  • Listings of independent contractors, and vendors of the targeted business (including IRS Forms 1099),
  • Copies of any letters issued by the Social Security Administration related to a social security number “no match,”
  • Copies of any petitions submitted to the United States Citizenship and Immigration Services (USCIS), and
  • Documents related to the employer’s formation and business activities.

Are you prepared if ICE comes knocking on your door?

Non-compliance exposes employers to a wide variety of potential penalties, including:

  • Up to $3,200 per unauthorized worker for the first violation,
  • Up to $6,500 per unauthorized worker, for the second violation,
  • Up to $16,000 per unauthorized worker for multiple violations,
  • Up to $1,100 per person for paperwork penalties, and
  • ICE may add or subtract 5 percent of the proposed penalty depending upon employer's size, good faith, seriousness, number of unauthorized aliens, and history of compliance.

Course Highlights:

Find out how your organization can ensure your I-9 practices are in compliance with ICE in this information packed audio conference on CD.  Leading employment law expert, David Whitlock, will guide you through the steps employers should take to ensure you’re in compliance, including:

  • Penalties for non-compliance
  • I-9s and independent contractors: who’s responsible?
  • Strategies for when you do not have I-9s for all current employees and no supporting document copies
  • If you hire employees from outside the US for overseas contracts, do you need to complete an I-9?
  • Anti-discrimination provision: Are you in violation?
  • When you must reverify, and when reverification is not needed
  • Your liability when contracting out work

During this comprehensive program you’ll also learn the critical answers to such “need-to-know” questions, like:

  • Which List A documents are acceptable?
  • What are the penalties for incorrect I-9s?
